What you need to know about Drunk Driving Charges In NJ

You may lose your commercial driver’s license (CDL) and have been charged with a DUI in NJ.

If you have a CDL and get charged with a DUI, you have a lot more to lose than most people.

The DUI rules in NJ are different for commercial drivers.

We are not here to scare anyone but a DUI conviction will complicate your life.

In addition to license suspensions and jail, NJ has extremely high fines and surcharges.

If you get a DUI in NJ, it will stay on your record forever.

In NJ, you get a “step down” every ten years.

This means that if you got your first DUI in the year 2000 & your second DUI in 2011, your second becomes your first. Did you see the math?

Since ten years passed between your first & second DUI, the second one is treated like a first.

If you are in this position, talk to us for free. We’ll explain it.

Moving on…

is a DUI in NJ a misdemeanor ?

The good news is that a DUI in NJ is a traffic offense.

It is not a criminal charge.

The bad news is that you can lose your driving privileges for up to 10 years.

More bad news is that you could go to jail for up to six months.

It does not matter if you have a driver’s license from another state.

The DUI from NJ will affect your driving record in your home state.

Can a NJ DUI be expunged?

An Expungement is a way of removing or cleaning your criminal record.

Since a DUI in NJ is a traffic offense, you can never expunge a DUI.

Sorry but it stays on your record forever.

For those of you with immigration challenges, you cannot expunge a DUI for immigration purposes.

More importantly, you cannot expunge ANY crime for immigration purposes.

An Expungement will not work for immigration applications.

Sorry but we are just trying to help.

This Attorney Is For Real
“We met with 5 different lawyers and they all seemed fake. We instantly knew when we met with Mr. Peyrouton that he was going to fight for my sister. My sister was in serious trouble but Alan researched and prepared everything and got her case dismissed. If I could, I would give Alan TEN stars because he’s such a fighter. Stop searching and wasting time…call Alan and meet with him first!”."

Does NJ Have DUIs for Prescription Drugs?

Of course we do.

To keep it simple, think of it this way.

Whenever anyone in NJ operates a motor vehicle under the influence of anything that impairs their ability to drive, they can be charged with a DUI. (Being convicted of DUI is another conversation)

An example would be over the counter cough syrup.

Now, when it comes to NJ DUIs for prescription drugs, the case is completely different than an alcohol DUI.

The things the police have to do during their investigation is completely different from a drunk driving case.

Instead of taking breath samples, the police draw blood.

It’s our job to make sure they did everything right.

Needless to say, these cases can become very complicated.

Another client review

"Boy did I pick the right lawyer. What really got me to choose him as a lawyer to represent me in my DUI case was that even before I even went into the office he took his personal time to have a detailed telephone conversation with me about the charges I faced. The first day that I actually went into his office, he welcomed me with open arms. What I liked was that he made me and my MOTHER feel comfortable and confident that he was the best choice to defend me in court. I faced multiple charges that would pretty much get my license taken away for good. He was able to ease my nerves and tell me possible outcomes he would fight for. He made me feel like he had my best interest at heart and he seemed passionate to do his best to try and help me."
